Legal expert Tareq Harb said on Monday that the government of resigned Prime Minister Adel Abdul-Mahdi can continue an additional year because an important condition has not been met.
Harb stated in a statement, “Abdul-Mahdi continues with his government to conduct matters even for a year until the handover of the new government, as there is no vacancy for the President of the Republic to assume the position of Prime Minister according to Article 81 of the Constitution, as freedom is achieved with the death of the resigned Prime Minister or his illness that prevents him from performing his duties or His abduction or absence, and intentionally not attending the official working hours, such as sitting at home or traveling and leaving Iraq, or having a physical objection to prevent him from performing his duties as normal conditions.
He added, “In this case, the President of the Republic fulfills the duties of the Prime Minister and we have in the previous year 2010, where Maliki remained in office for seven months after the end of the four years and the election of a new parliament. Abdul-Mahdi did not complete the four years specified constitutionally for his government, and he was the one who resigned and was not sacked by Parliament, as he did not withdraw confidence from him. There is no constitutional scope for the President of the Republic to assume the position of Prime Minister, because the vacancy is not achieved.
