{Baghdad: Al Furat News} The Iraqi Constitutional Council has determined the authority to declare any state of emergency in the country.
The text of paragraph IX of Article 61 of the Constitution on the authority of the House of Representatives
states : A- Approval of declaring war and a state of emergency by a two-thirds majority, based on a joint request from the President of the Republic and the Prime Minister.
B- The state of emergency shall be declared for a period of thirty days, which can be extended, and with approval each time.
C- The Prime Minister gives the necessary powers that enable him to manage the affairs of the country during the period of the declaration of war and the state of emergency, and these powers are regulated by law, in a manner that does not contradict the constitution.
D- The Prime Minister shall present to the House of Representatives the measures taken and the results, during the period of declaring war and the state of emergency, within fifteen days from the date of its end.
The President of the Republic, Barham Salih, and the Prime Minister {resigned} Adel Abdel-Mahdi, addressed a message to Parliament Speaker Mohamed al-Halbousi, requesting the declaration of a state of health emergency for thirty days, which could be extended, according to Article 61 of the Constitution.
While a legal expert revealed who has the constitutional authority to declare any state of emergency in the country.
Tareq Harb told Al-Furat News that “there is no authority for the Speaker or his deputies (the Presidency of the Parliament), whether they are together or individually, because the constitution obliged members of the House of Representatives to vote by a majority to declare any emergency in the country.”
He added, “The presidential request to declare the emergency is a valid legal procedure, but the constitution clarified and specified the party responsible for that, which is the parliament.”
It is reported that the Ministry of Health announced yesterday that the death rate of coronavirus in the country increased to 10 cases and the injury of 110 cases.
