The resigned Prime Minister, Adel Abdul Mahdi, today, Monday, sent a message to President of the Republic Barham Salih, Speaker of Parliament Muhammad Al-Halbousi and to the deputies, on the occasion of the end of the constitutional period to obtain the trust of the commissioner, Mohammed Tawfiq Allawi, who announced his apology for the assignment.
The text of Abd al-Mahdi’s message reads as follows:
“Honorable President of the Republic, Honorable
Speaker of Parliament, gentlemen, ladies, vice presidents and respected members of Parliament,
Peace and God’s mercy and blessings be upon you,

express my deep sorrow for the failure of Brother Muhammad Tawfiq Allawi in his mission to form the new government, which requires us Take the mu Stand today, and announce today before our honorable people and before you that the most dangerous thing facing us today is the occurrence of a constitutional and administrative vacuum, and the best solution is to adhere to the relevant constitutional articles, the prevailing laws and the articles of the internal system of the cabinet issued on 25 March 2019 published in the Official Gazette in issue 4533 which was based On the constitution in accordance with Article (85) thereof, and accordingly, after consulting with constitutional and legal experts from among the specialists, I announce a decision that I have taken, which is to resort to (voluntary absence) as the Prime Minister with all the resulting procedures and contexts, and some of them will be explained below.
This position does not mean that it is not possible to resort later to declaring that the position is vacant according to Article (81) of the Constitution, if the political forces, the legislative and executive powers do not reach the contexts that the country emerges from its current crisis, according to Article (76) of the Constitution. In implementation of the decision it has taken, we will start in accordance with the constitutional, legal and regulatory powers granted to us immediately by:
1- Calling the distinguished parliament to hold an extraordinary session to finalize the election law, the electoral districts and the electoral commission. We propose on December 4, 2020 as the date for the elections, and to provide the Commission with all the requirements that enable it to hold free and fair elections on the proposed date. And that the distinguished parliament dissolve itself 60 days before the mentioned date. And that another fund be organized next to the ballot boxes or on the back of the election coupon to conduct a referendum on constitutional amendments, that the esteemed parliament may approve according to its mechanisms before dissolving itself.
2- Assigning one of the deputy prime ministers or one of the ministers the responsibility of managing the cabinet sessions and conducting daily matters, according to Article (3) of the internal system of the cabinet. It is a measure that we began to implement since Professor Muhammad Tawfiq Allawi was tasked with forming the new government.
3- The internal system of the Council of Ministers specifies, in particular, Articles (20) and (29) and Order No. 68 of 2004 that the Ministerial Council for National Security is responsible for “facilitating and coordinating the national security policy between ministries and institutions of the Iraqi government charged with national security issues” and operates under the control and control of a president The Council of Ministers is the Commander-in-Chief of the Armed Forces. The National Security Adviser continues to exercise the role of the Secretariat of the Ministerial Council for National Security, organizing its agenda and communicating its decisions in accordance with the established work contexts. 4- The Director of the Prime Minister’s Office, the Secretary General of the Council of Ministers, and the Personal Secretary of the Commander in Chief shall notify the Prime Minister, the Commander in Chief of the Armed Forces of the exclusive, urgent, and necessary matters adjacent to his address so that they are dealt with in accordance with the powers of the day-to-day government, in order to prevent any vacancy in duties The Executive Authority and Commander-in-Chief of the Armed Forces.
5- Except for what is stated in (4) or the ruling constitutional texts, the Prime Minister will be absent from signing official books or answering invitations or conducting meetings or discussions and official local or foreign meetings, and officials continue each of his site to ensure the management and conduct of business and the signing of transactions and prevent any An official vacuum in dealing with local and foreign files that the Prime Minister will be absent from, and institutions operate daily matters in accordance with the contexts currently in force. The opinion of the government and the leadership of the armed forces will be expressed by official spokespeople as intended.
6- We call for the formation of the new government as soon as possible in accordance with Article (76) of the constitution. Neither is the government of managing daily matters the right solution that Iraq needs in these sensitive circumstances, nor is absenteeism or vacancy the ideal solutions, and we hope that the constitutional institutions concerned bear their responsibilities.
