Legal expert Saad Al-Bakhati confirmed that the process of forming the three presidencies is one of the most dangerous and delicate constitutional procedures in the Iraqi political system, due to the legal and political consequences that affect the stability of the state and its institutions.
Al-Bakhati told Al-Maalouma that adhering to the constitutional deadlines for selecting the President of the Republic, appointing the Prime Minister, and forming the government is an absolute necessity that cannot be bypassed, warning that any breach of these deadlines could open the door to constitutional crises and disrupt the work of the authorities.
He added that the political paths currently adopted in the mechanism for selecting the three presidencies are proceeding so far within the correct framework, despite the existence of complications resulting from political differences and multiple constitutional interpretations, noting that past experiences have proven that delays often have a negative impact on political and economic stability.
Al-Bakhati pointed out that the political process still lacks clear and institutional mechanisms for selecting presidencies and sovereign positions, which makes it subject to political compromises more than relying on fixed constitutional and legal standards.
He concluded by emphasizing that addressing this deficiency requires enacting laws that complement the constitution and clearly regulating the selection mechanisms, ensuring respect for constitutional deadlines, strengthening public trust in institutions, and preventing the country from entering a constitutional vacuum or recurring political crises.
