Legal expert Ali al-Tamimi confirmed on Monday that the 15-day constitutional deadline for the largest bloc to nominate its candidate for prime minister is a procedural, not mandatory, period. He stressed that exceeding this deadline does not result in the loss of the legal right to nominate.
Al-Tamimi told the Information Agency, “Constitutional deadlines represent guarantees for the stability of the political system, and the Iraqi Constitutional Court, through its decision (76 of 2009), has established precise controls for calculating these deadlines and preventing a constitutional vacuum.”
He added, “Exceeding the deadline mentioned in Article 76 of the Constitution constitutes a procedural constitutional violation, but it still preserves the right of the largest bloc to nominate its candidate.” He explained that “this period is procedural because the Constitution does not stipulate any penalty or punishment for exceeding it that would forfeit the right to nominate, and thus the legal path remains open for the bloc in question to secure the position.”
