Legal expert Ali Al-Tamimi confirmed on Thursday that the establishment of the Supreme Sovereign Council for Integrity is not in accordance with the provisions of the Iraqi Constitution, noting that placing oversight under the authority of the Prime Minister represents a clear legal contradiction. Al-Tamimi stated in an interview with Al-Maalomah News Agency, “The proposed council includes the Integrity Commission and the Federal Board of Supreme Audit and is headed by the Prime Minister, while these two institutions are independent authorities exclusively linked to the Council of Representatives, according to Articles 101 and 102 of the Constitution.”
He added, “The Integrity Commission and the Federal Board of Supreme Audit are tasked with monitoring the performance of the Prime Minister’s office, ministries, and all executive institutions. Therefore, the head of the executive branch chairing this council constitutes a constitutional violation and undermines the independence of oversight bodies.”
Al-Tamimi clarified that “Article 61 of the Constitution grants the Council of Representatives the exclusive authority to legislate federal laws, meaning that the establishment of any new body or council must be approved by Parliament and cannot be enacted through executive decrees.”
