MP Ghalib Muhammad, from the Kurdistan Hope Alliance, confirmed today, Monday, that three lawsuits have been filed before the Federal Court concerning the reality of constitutional institutions in the Kurdistan Region, expressing his hope that the court will deal with these files fairly, and put an end to constitutional violations in the region.
Mohammed told Al-Maalomah, “The first lawsuit was filed against the designation of the current Kurdistan Regional Government as a caretaker government, despite it exercising broad powers even though the constitutional term granted to it has expired. The second lawsuit was filed against the Kurdistan Region Parliament, which remains closed and has not been able to perform its legislative and oversight role as required, despite the passage of nearly two years since the legislative elections in Kurdistan.”
He added that “the third lawsuit includes a request to issue a court order to cut the salaries of members of the Kurdistan Region Parliament, on the grounds of their irregular attendance and failure to come to the parliament building and perform their duties,” indicating that “the continuation of the current situation represents, in his view, a clear violation of constitutional and legal texts.”
Mohammed pointed out that “the current government in the Kurdistan Region is practically a caretaker government, but at the same time it has broad powers that exceed the powers of the federal Prime Minister, Ali al-Zaidi,” noting that “Masrour Barzani has greater powers than the federal Prime Minister.”
He added that “the continued functioning of institutions in this manner, with parliament paralyzed and the formation of a government delayed, raises serious questions about respect for the constitution and the separation of powers,” calling on the Federal Court to “resolve the pending cases and issue rulings that ensure the return of constitutional institutions in the region to their legal course, protect citizens’ rights, and prevent the continuation of the political and institutional paralysis.”
