Constitutional law expert Ali al-Tamimi confirmed on Wednesday that the Iraqi Parliament has the legal authority to extend the term of the caretaker government and grant it full powers, basing this on the principles of the Iraqi Constitution, which grants Parliament the role of the highest legislative body.
Al-Tamimi told the Information Agency, “The caretaker government, in its current state, is temporary and powerless, as its role is limited to routine matters without the right to make critical decisions or legislate. However, the current security conditions plaguing the region allow Parliament to extend its term with broader powers.”
He added, “Article (5) of the Constitution, which stipulates that ‘the people are the source of all powers,’ and Article (6), which concerns the peaceful transfer of power, provide the legal basis for this measure.” He pointed out that “Parliament, according to Article (61), has the right to declare a state of emergency and extend the government’s term based on a joint request from the President of the Republic or the Prime Minister, provided that two-thirds of the members of Parliament vote in favor.”
