Legal expert Musaddaq Adel confirmed on Tuesday that Article 76 of the Constitution, which pertains to the mechanism for submitting the cabinet, does not specify a fixed number of ministers that the prime minister-designate must present. He explained that political custom and Federal Court rulings permit the cabinet not to be fully completed within the constitutional deadline.
Adel told Al-Maalouma, “The prime minister-designate can proceed with submitting an incomplete cabinet within the 30-day period, provided there is a prior political agreement.” He clarified that “the Constitution focuses more on timeframes than on the total number of ministers in the initial batch.”
He added that “the law stipulates that for Parliament to convene and grant confidence to the government, the number of ministers presented must exceed half plus one of the total proposed cabinet.” He pointed out that “this quorum is the legal guarantee for ensuring the legitimacy of the vote and the commencement of executive duties.” It should be noted that the confidence vote session requires a quorum of members of parliament, while consultations continue between political forces and the prime minister-designate to overcome the obstacle of vacant ministerial posts in the first phase of the cabinet formation.
