MP Mohammed Jassim Al-Khafaji announced on Sunday that he had filed an appeal with the Federal Supreme Court (the highest judicial authority in Iraq) regarding the vote on three deputy prime ministers and the creation of three new ministries in the Iraqi government.
Al-Khafaji said in a post on the social networking site Facebook that the appeal focused on stating the violation of the provisions of the constitution as follows: Violation of Article (139) of the constitution, as it was included among the articles of the transitional provisions and stipulated that the Prime Minister should have two deputies, and only in the first parliamentary session.
He pointed out the violation of Article (76), which included voting on the President and members of the Council of Ministers only, and not including Vice Presidents, and the violation of Article (61) of the Constitution, which mandated parliamentary oversight of the Prime Minister, ministers, and heads of independent bodies, and the Constitution did not mention Vice Presidents.
The list also included a violation of Article (86) by creating ministries without prior legislation as required by the constitution, and a request to reverse a previous decision issued 15 years ago concerning the same subject, according to Al-Khafaji.
Last Thursday, the Iraqi parliament voted on three deputy prime ministers, including Ali al-Zaidi, and on 11 candidates for vacant ministries, including a minister of state, with the exception of the Ministry of Immigration.
