On Wednesday, the Federal Supreme Court issued a ruling nullifying the lawsuit filed by former MP Raed al-Maliki, in which he challenged the presidential decree appointing Ali Faleh al-Zidi to form the Council of Ministers, thus confirming the validity of the constitutional procedures in his appointment.
The plaintiff, former MP Raed Al-Maliki, had filed a lawsuit before the Federal Supreme Court requesting a ruling that “Republican Decree No. (20) of 2026, which appointed Ali Al-Zidi as Prime Minister, is invalid.”
According to documents published by Shafaq News Agency, the judicial body headed by Judge Munther Ibrahim Hussein decided to invalidate the lawsuit petition based on the provisions of Article (88) of the Civil Procedures Law No. (83) of 1969, as amended.
The decision included charging the plaintiff the legal fees and attorney fees of the defendant’s agent, amounting to one hundred and fifty thousand dinars, to be distributed in accordance with the law. The court also decided that its decision would be final and binding, based on the provisions of Article (94) of the Constitution of the Republic of Iraq of 2005. The decision was issued unanimously.
The court had previously set a hearing date for this lawsuit, which was filed by Al-Maliki in his personal capacity, objecting to Al-Zaydi’s appointment on several points, including “his failure to meet the nomination requirements, the existence of a conflict of interest, and the procedural defect in the appointment process.”
The defendant, represented by the President of the Republic, responded through his agent, the head of legal experts, Ghazi Ibrahim Al-Janaibi, requesting that the lawsuit be dismissed.
With this decision, the Federal Supreme Court has settled the legal debate over the constitutionality of assigning Ali al-Zaidi, thus paving the way for him to continue his mission of forming the new government.
