In 2018, during his first term as president, Trump banned transgender people from serving in the military except in exceptional circumstances. The ban also affected people with gender dysphoria, a condition associated with transgender people where a person cannot fully accept their gender identity. Transgender people were granted the right to serve in the US military in 2016 by order of President Barack Obama.

After his inauguration in January, Trump reversed the rule imposed by his predecessor, Biden, that “gender identity should not be a barrier to military service and that the strength of the United States lies in its diversity.”

On January 20, 2025, Trump signed an executive order recognizing only two biological sexes, male and female, and restoring biological truth at the federal level under a document called “Protecting Women from Gender-Based Ideological Extremism and Restoring Full Biological Truth to the Federal Government,” and at the state level the following categories will be created: “woman,” “girl,” “man,” “boy,” “female,” and “male.”

Under the law, all agencies must use these categories only “when interpreting or applying laws, regulations, or guidelines, and in other official agency activities, documents, and communications,” and agency questionnaires should not include any questions about gender identity.
