The Khor Abdullah issue is still pending the Federal Court’s decision on whether to accept the appeal submitted by the executive authority or to annul the agreement and return the creek to Iraq as a right of the country and within the internationally agreed upon maritime map. However, the resignation of nine members of the Federal Court has thrown matters into a new maze regarding the upcoming parliamentary elections and may also push the Khor Abdullah issue back after it was expected to rule on the issue and establish justice. At a time when parliamentary and political circles have expressed their criticism of this development, hopes were pinned on a decision by the court that would serve the interests of the Iraqi people and restore their usurped rights.

MP Yasser Al-Husseini told Al-Maalouma that “great pressure is being exerted on the Federal Court, which has led to the resignation of a number of its members in an attempt to influence its decision regarding the invalidity of the Khor Abdullah Agreement.” He stressed his rejection of attempts to waive the rights and interests of Iraqis under any pretext, denouncing attempts to politicize the judicial decision and regional or international alignment against the national interest. He pointed out that “the appeal filed by the President of the Republic and the Prime Minister against the court’s decision is surprising and unjustified.”

Al-Husseini accused the current government of “exploiting its influence and stalling the submission of the Federal Court’s ruling to international organizations, allowing the Kuwaiti side to build offshore platforms within Iraqi waters and obtain international documentation, taking advantage of official Iraqi laxity.”

On the other hand, Naseem Abdullah, a member of the Political Bureau of the Iqtidar Movement, confirmed to Al-Maalouma that “all political parties agree to hold the elections on the scheduled date, and the issue of the resignation of the Federal Court members and its impact on the elections is still not settled, as the President of the Republic has not yet announced his approval of the resignations submitted by a number of court members. As a result, the issue is not only related to the resignation, but there are many entitlements at the level of the elections and the regional situation as well, all of which affect the internal situation.” He indicated that “the political agreement and the regional situation in the region are confusing in the current situation, as the resignation of the court members at the present time is still a subject of discussion, as the political forces will meet and find a way out of the current crisis, especially since the current situation requires the political forces to agree among themselves to ensure a resolution to the crisis, given that the origin of the problem related to the resignations goes back to the political aspect.”

On a legal level, constitutional and legal expert Musaddiq Adel explained to Al-Maalouma, “There is political pressure regarding Khor Abdullah, but this does not push the judge to be affected by these pressures and give up his independence, as the independence of the judge must be far from political influences, as if the judge is affected by political pressures, it means that he is not fit to exercise the judicial function, while dozens of judges in Iraq have carried out their investigative work, issued death sentences and were subjected to assassinations, but in the eyes of the people they carried out their work away from pressures.”

He pointed out that “the issue of some judges submitting resignations as a result of being influenced by political pressure is unacceptable and they can be held accountable and go further and reject these resignations. It is likely that the Judicial Council will not allow the Federal Court judges to evade their responsibilities before the people,” adding that “these resignations will not leave a constitutional vacuum, as the court, despite its constitutionality, was not formed in a constitutional manner, as its law stipulates the presence of judges, Islamic jurisprudence experts and legal experts. With the acceptance of the judges’ resignations, the court that will be formed will be unconstitutional.”
