Legal expert Ali Al-Tamimi revealed, on Saturday, the constitutional steps in the event that the House of Representatives did not pass the cabinet of the Prime Minister-designate, Mohammed Tawfiq Allawi.

He added, “It is not possible according to the third and fifth paragraphs of Article 76 of the constitution to limit the choice of the President of the Republic, and the President of the Republic is free and unrestricted in the selection of other candidates after the failure of the candidate of the largest bloc. It is not logical that the President of the Republic return after the failure of the candidate of the largest bloc upon his assignment, that He returns to the same big bloc until he nominates another candidate after the failure. ”

He explained that “now if Parliament does not vote for Muhammad Allawi and does not give him confidence and leave Abdul-Mahdi for the post, the President of the Republic will take the position of Abdul-Mahdi in assuming the position of Prime Minister in accordance with Article 81 of the Iraqi constitution, absolutely without specifying the period of the President of the Republic to take office and without specifying the authority, where the President The Republic shall appoint another candidate for prime minister within 15 days from the date when the position is vacant, as the same article states.

Al-Tamimi indicated that it is possible to resort to the Federal Court to explain the ambiguity contained in Article (76 and 81) of the Constitution.

It is noteworthy that the Parliament is scheduled to hold an extraordinary session for it tomorrow, Sunday, after it was scheduled today and it was postponed until tomorrow based on a request submitted by the Prime Minister-designate, Mohammed Tawfiq Allawi.
