Legal expert Dhafer al-Zarfi confirmed on Saturday that the framework agreement signed between the Iraqi government and Turkey lacks legal standing unless it is officially presented to the Council of Representatives. He stressed that any international agreement must be subject to legislative oversight before entering into force.
Al-Zarfi told the Information Agency, “The framework agreement concluded by the government with Ankara, regardless of whether it is called an agreement or a memorandum of understanding, cannot be legally valid without Parliament being informed of its terms, discussing them, and voting on them according to constitutional procedures.”
He added, “The Council of Representatives possesses full oversight powers that authorize it to request the terms of the agreement and question the Ministry of Foreign Affairs and the government about it, especially since the issues with Turkey are related to Iraq’s sovereignty and vital matters, including security, water, and borders.”
Al-Zurfi explained that “bypassing the legislative body in such sensitive matters places the agreements in a constitutional predicament that could open the door to legal challenges both domestically and internationally.” He pointed out that “the secrecy surrounding the details of the agreement raises legitimate questions that necessitate transparency and urgent parliamentary review.”
This comes amidst escalating public and political debate regarding the nature of the agreements with Ankara, at a time when experts and parliamentary blocs are demanding the activation of Parliament’s oversight role to ensure that no commitments affecting Iraqi sovereignty are passed without national consensus and official approval.
