Political affairs researcher Mohammed Daham affirmed on Monday that the government is obligated to abide by the decisions issued by the Federal Supreme Court regarding the four MPs elected to the premiership and the legal nature of this election, stressing the necessity of resorting to the constitution to resolve this issue.
Daham told Al-Maalouma that “the Federal Court bears the responsibility of correcting legal procedures and overturning any decision that contradicts the provisions of the constitution,” explaining that “the election of the four MPs to the premiership raises questions about the existence of a constitutional basis that permits this mechanism.”
He added that “the appeal related to this issue is admissible in form and substance, given the perceived absence of a clear constitutional provision regulating this situation, which makes the related decisions subject to appeal if their violation of the constitution is proven.”
Daham clarified that “resolving this matter requires returning to the constitutional texts and applying them clearly,” emphasizing that “the government cannot disregard or refuse to comply with the decisions issued by the Federal Court, as it is the competent authority to adjudicate constitutional matters.”
He pointed out that “respect for the constitution is the foundation of the legitimacy of state institutions, and adherence to its provisions and the decisions of the Federal Court is essential for preserving the prestige of the state and ensuring the integrity of political and legal procedures.”
