Legal expert Habib Al-Quraishi confirmed that constitutional deadlines are considered “sacred times” in constitutional systems, noting that Iraq has violated this sanctity more than once, which has negatively affected the stability of the political process and the performance of legislative institutions.
Al-Quraishi told Al-Maalouma that the Iraqi constitution does not contain an explicit text that specifies the legal consequences of not electing the Speaker of Parliament in the first session, indicating that this constitutional vacuum has opened the door to repeated crises and differing political interpretations.
He added that violating or exceeding the constitutional deadline practically leads to the same result, which is disrupting the constitutional process and weakening the legitimacy of subsequent procedures, stressing that the continuation of this approach perpetuates a state of instability within the legislative institution.
Al-Quraishi pointed out that the next parliament will witness a major change that may reach about 260 new deputies, which reflects the state of popular dissatisfaction with the previous parliamentary performance, and places on the next council the responsibility of correcting the constitutional and legislative course.
He explained that the Supreme Federal Court has the authority to exercise constitutional interpretation, and it can issue a decision to dissolve the House of Representatives and call for new elections if the election of the presidencies continues to be obstructed and the constitutional deadlines are not adhered to.
Al-Quraishi concluded by saying that “respecting constitutional deadlines is the cornerstone of any political stability,” warning that “continued violations could push the country towards exceptional judicial solutions that would reshuffle the political landscape once again.”
