Legal expert Ali Al-Tamimi confirmed today that the decision of the Supreme Federal Court to end the work of the House of Representatives and transform the current government into a caretaker government had direct constitutional consequences, most notably considering the members of the fifth parliamentary session as former members according to the internal regulations of the House of Representatives.
Al-Tamimi said in a statement followed by the Al-Maalouma Agency, “The Supreme Federal Court issued a decision on November 17 to end the work of the House of Representatives, which means the end of the parliamentary status of the members of the council, and consequently their loss of the privileges and duties associated with the legislative status, except for what is stipulated by law in terms of subsequent retirement or administrative rights.”
He added that “turning the government into a caretaker government restricts its powers constitutionally, and limits its tasks to running daily affairs and not making strategic or legislative decisions, until a new government is formed emanating from an elected parliament.”
Al-Tamimi pointed out that “this stage is transitional and sensitive, and requires speeding up the completion of constitutional requirements, especially calling for early elections or forming a new legislative authority in accordance with the approved legal frameworks.”
He concluded by saying that “respecting the decisions of the Federal Court is a fundamental guarantee for the stability of the constitutional order, and places all authorities before their legal responsibilities in managing the next phase within the framework of the constitution and the law.”
