Iraqi MP Amer Abdul Jabbar revealed on Thursday that he had collected the signatures of 200 of his fellow MPs and submitted them to the Federal Court to support its decision to annul the Khor Abdullah agreement with Kuwait. He called for a demonstration tomorrow, Friday, in support of the Federal Court’s ruling.

Abdul-Jabbar told Shafaq News Agency, “Today, we met with the head of the Federal Court, and we submitted to him a request signed by 194 MPs, addressed to the court, through which we support the court’s decision to cancel the Khor Abd Allah agreement.”

Abdul-Jabbar continued, “We, the signatories, demand that Prime Minister Mohammed Shia al-Sudani implement the Federal Court’s decision to annul the agreement.” He called on Iraqis to “take to the streets on Friday afternoon in peaceful demonstrations to support the Federal Court’s decision to annul the agreement.”

Shafaq News obtained a copy of the document signed by 194 representatives, which stated: “We, the undersigned representatives, reject the humiliating Khor Abdullah Agreement, and we demand the Prime Minister to implement the Federal Court’s decision No. 105/ and its unified decision No. 194/Federal/2023 issued on April 9, 2023, and deposit it with the United Nations and the International Maritime Organization (IMO) in accordance with what was stated in the Ministry of Foreign Affairs’ letter addressed to the Prime Minister, No. 1532, dated December 25, 2023. Then, approach the Kuwaiti side for the purpose of negotiating again, provided that the Iraqi negotiating team consists of specialized experts and those with extensive experience without any political interference, and that the negotiations be held in Baghdad or in a neutral third country agreed upon by both parties in order to establish justice between the two brotherly countries in accordance with international agreements and norms.”

The agreement regulating navigation in Khor Abdullah, concluded in 2012 between the Republic of Iraq and the State of Kuwait, is a technical and administrative solution to the effects of the invasion of Kuwait by Saddam Hussein’s regime in 1990 and the resulting demarcation of borders pursuant to Security Council Resolution No. (833) of 1993. Article 6 of the agreement affirms that “the agreement does not affect the borders between the two parties in Khor Abdullah established pursuant to Security Council Resolution No. (833) of 1993.”

The Iraqi Council of Ministers approved the draft ratification law at the end of 2012, and the House of Representatives approved it by a simple majority under Law No. (42) of 2013, and then it was published in the Iraqi Gazette, Issue No. (4299) dated 11/25/2013.

The instruments of ratification were deposited with the United Nations, a copy of which was sent to the International Maritime Organization, and the Convention entered into force on the basis of the pacta sunt servanda rule.

The Federal Court issued its decision No. (21/Federal/2014) on 12/18/2014, distinguishing between the law regulating the process of ratifying treaties, which requires a two-thirds majority according to Article (61/Fourth) of the Constitution, and the law ratifying a specific agreement, which is approved by a simple majority according to Article (59/Second).
