The three presidencies held a meeting today, Tuesday, at the Baghdad Palace, attended by Prime Minister Mohammed Shia al-Sudani, President Abdul Latif Jamal Rashid, and Parliament Speaker Mahmoud al-Mashhadani.
A statement issued by Al-Sudani’s office stated that the meeting discussed regional developments and the need to maintain the path set by the government to protect Iraq from danger and preserve the country’s security.
The statement added that the presidents discussed preparations for the parliamentary elections and supported the steps taken by the Independent High Electoral Commission to hold free and fair elections on the scheduled date of November 11, 2025.
According to the statement, the presidents discussed the issue of the agreement regulating navigation in Khor Abdullah, which was ratified by the esteemed House of Representatives pursuant to Law (42) of 2013, and the Federal Supreme Court decided that the quorum of its legislation was unconstitutional from a formal point of view, pursuant to its decision in case numbered (105/ and its unified 194/ Federal/ 2023).
The statement indicated that the following was agreed upon:
1. The necessity for the House of Representatives to take the required legislative action, in accordance with the Federal Court’s decision that required the proper re-enactment of the law ratifying the agreement.
2. The Presidency of the Republic and the Prime Minister shall withdraw the request for reversal submitted by each of them to the Federal Court, as there is no longer any need for it after proceeding with the legislative process.
3. Affirming Iraq’s commitment to international agreements, UN charters, and UN Security Council resolutions.
The presidents stressed the need to handle international issues with caution and care, and not exploit them for political and media controversy and outbidding, as this would harm Iraq’s rights, foreign reputation, and interests, according to the statement.
For his part, Member of Parliament Saud Al-Saadi said in a statement issued following the presidencies meeting, “The Iraqi authorities are committed to invalidating the humiliating agreement and stress the need to adhere to the legislative process and withdraw the appeals of the President and Prime Minister to revoke the agreement.”
He added, “We await another patriotic and honorable stance from the Iraqi judiciary regarding our appeal of Resolution No. 266 of 2025 regarding the demarcation of the joint Iraqi-Kuwaiti maritime border.”
Kuwaiti media reported in mid-April that Iraqi President Abdul Latif Rashid and Iraqi Prime Minister Mohammed Shia al-Sudani had filed two separate appeals with the Iraqi Federal Supreme Court against its decision to invalidate Law No. 42 of 2013 ratifying the agreement between Iraq and Kuwait regulating navigation in Khor Abdullah. The appeals demanded that the court rescind the decision and restore the existing agreement between the two countries.
On September 4, 2023, the Federal Supreme Court ruled that Law No. 42 of 2013, the law ratifying the agreement between the government of the Republic of Iraq and the government of the State of Kuwait regarding the regulation of maritime navigation in Khor Abdullah, was unconstitutional.
The court stated in a brief statement at the time that it “issued its decision as unconstitutional due to its violation of the provisions of Article 61/Fourth of the Constitution of the Republic of Iraq, which stipulates that ‘the process of ratifying international treaties and agreements shall be regulated by a law enacted by a two-thirds majority of the members of the House of Representatives’.”
