The House of Representatives is awaiting a decision and ruling from the Federal Court to return the Khor Abdullah Agreement to the House for confirmation and a vote on its invalidity. Although there are indications that the will of the government and the presidency to proceed with the agreement and hand over Khor Abdullah to Kuwait on a golden platter may be accepted, matters may then deteriorate and go further, especially since there are popular and parliamentary circles and activists awaiting a decision on the Khor. If the results are far from the will of the Iraqis, it is likely that the street will flare up again in the blazing summer heat to have its say with all candor regarding those who are trying to squander Iraq’s land and waters in favor of the other party.

“Re-introducing the agreement to parliament will be met with a decisive response, especially since the majority of parliament members are prepared to vote to annul the agreement, in support of the Federal Court’s decision, which was based on constitutional and legal foundations. Previously, passing the agreement was illegal due to the lack of a quorum for a vote in parliament, which makes its annulment a legitimate matter from a legislative standpoint,” Member of Parliament Zahra Al-Bajjari told Al-Maalouma. “Khawr Abdullah is entirely Iraqi, and no part of Iraqi territory can be relinquished under any pretext,” she added.

On the other hand, independent politician Abbas Al-Maliki confirmed to Al-Maalouma that “there are many activists, observers and citizens who are waiting for a decision from the Federal Court to heal their hearts regarding the Khor Abdullah issue, as relinquishing this right, whether demonstrations take place in the Iraqi street or not, represents a stain on the forehead of the party that is relinquishing Iraqi waters. Citizens are supposed to wait for the executive authority, as well as Parliament and all concerned parties to stand by national issues without relinquishing them.” He indicated that “if the defunct regime had relinquished part of Iraqi land and water under certain circumstances, it would have lost the war and the battle and conditions were imposed on it. Therefore, Iraq’s right cannot be relinquished or linked to a specific person. Rather, it was supposed to turn to the international community to guarantee Iraq’s right to its waters and land.”

In a related development, Member of Parliament Mohammed Anouz explained to Al-Maalouma that “Parliament cannot override the Federal Court’s decision, which invalidated the agreement because it was not based on sound legal foundations. The majority in Parliament will support the court’s decision if the agreement is presented again.” He stressed that “the issue is not related to changing the borders. Iraq’s borders are historically known and new borders cannot be imposed on them.” He pointed out that “Parliament intends not to relinquish any part of Iraq’s land, no matter the cost, and Iraq’s rights will be firmly established.”

The Federal Court is expected to resume its sessions after a new president is elected, to consider the Khor Abdullah case and issue its final decision on the agreement, either by passing the government’s projects and granting Kuwait Khor Abdullah or by canceling the agreement to ensure the return of water to its Iraqi course and to prevent the relinquishment of this creek.
