Revealing the mechanism for selecting replacements for judges who resigned from the Federal Court

Legal expert Ali Al-Tamimi revealed, on Friday (June 20, 2025), the mechanism for selecting replacements for judges who resigned from the Federal Supreme Court.
Al-Tamimi said in a press interview, “The selection of replacements for the judges who resigned from the Federal Supreme Court is done through the nomination of new judges by the Supreme Judicial Council and the Ministry of Justice in the Kurdistan Region, which has two representatives. Following this nomination, a presidential decree is issued regarding them by the President of the Republic.”
He added that “the resignation of such a number of judges from the Federal Supreme Court is unprecedented,” considering it “will not affect the entity of the court or its constitutional status.” He pointed out that “the judges will be replaced by nominating replacements, and the matter will probably be resolved in a few days by the Supreme Judicial Council and the Ministry of Justice in the region.”
Nine members of the Federal Supreme Court, including six full members and three reserve members, officially submitted their resignations in protest against what they described as “extreme pressure” exerted on the court in the maritime border demarcation case in the Khor Abdullah dispute.
In a related context, Hazem al-Radini, head of the Strategic Center for Human Rights in Iraq, warned on Friday of the danger of accepting the resignations of Federal Court judges during this period.
In a statement issued by the center’s media office, Al-Radini said, “The upcoming parliamentary elections in November 2025 cannot be held without the presence of members of the Federal Court, as Article 93/7 of the 2005 Iraqi Constitution stipulates that the Federal Court has the authority to ratify the final parliamentary election results.”
He added, “This will result in a legislative vacuum due to the expiration of the House of Representatives’ term under Article 49 of the Constitution, which sets its term at four years from the date of the first session. This means it will end on November 25, 2025, and the government will become a caretaker government.”
