Al-Maliki wins for the Federal Court - Voting on the three laws is incorrectShafaq News/ The head of the State of Law Coalition, Nouri al-Maliki, confirmed on Monday that the vote on the three controversial laws in the House of Representatives is incorrect, justifying that by saying that the vote was done with one basket and the number “half plus one” was not completed.

Al-Maliki said in a televised speech, followed by Shafaq News Agency, that “a state not governed by law is invaded by chaos and outlaws,” indicating that “in order to form the state and society on sound foundations, justice and fairness must be provided among the components of society.”

Al-Maliki continued: “The rule of the judiciary must be supported as it is the final guarantee to control the course of events. One of the sources of strength of the judiciary is that it is independent, neutral, and free from pressure.”

He pointed out that “there has recently been an unjustified uproar over laws that have not completed the legislative element, and one of the problems with these laws is that they were voted on in one basket, which led to the passage of a problematic law under the umbrella of a law that has support.”

He explained that “this context was not in effect in the House of Representatives, and each law was supposed to be enacted individually,” noting that “the second problem is that the vote did not reach the required number, which is half plus one.”

Al-Maliki concluded by saying: “Unfortunate practices occurred after the voting on the three laws, reminding us of the challenges that led Iraq to further deterioration and bloodshed.”

Last Tuesday, the Federal Court issued a federal order to stop the implementation of the three laws, personal status, general amnesty, and real estate, approved by the House of Representatives. However, this order was met with widespread rejection by Sunni political forces, and to a lesser extent Kurdish ones.

The Iraqi Supreme Judicial Council ruled last Wednesday that it is not permissible to stop the implementation of laws that are legislated by the House of Representatives before they are published in the Official Gazette, while it considered the law amending the Personal Status Law and returning properties to their owners to require delaying the issuance of any decision related to them, stressing that the courts in the country are obligated to implement the general amnesty law.

As of Thursday, the courts in the Iraqi governorates began implementing the amendment to the general amnesty law in accordance with its provisions and the instructions issued by the Supreme Judicial Council in this regard, despite the objection of the Federal Supreme Court, the highest judicial authority in the country.

The Iraqi Parliament session on January 21 witnessed the passing of “controversial laws” including amending the general amnesty law, amending the personal status law, and the law to return properties to their owners in Kirkuk.

The session also witnessed the collection of signatures to dismiss the Speaker of the Council, Mahmoud Al-Mashhadani, in protest against the voting mechanism, which some representatives considered a violation of constitutional procedures.
